Lucy Limbaugh: Fraud Allegations
In our opinion, Lucy Limbaugh of Texas Heritage Properties in Houston, Texas committed fraud when she prevented us from closing on one property in order to sell us a higher priced property.  Because she was both the listing and the selling agent for both transactions, no other agent was able to question the lies she told to stop the first sale.  Both parties in the original transaction incurred real financial damages as well as personal hardship as a result of Lucy's behavior. 

Although we were always suspicious, we were unable to prove that Lucy pulled a fast one until June, 2010.  At that time, we listed our home with an agent who looked into the records and discovered the apparent Fraud.  Our experience suggests that Lucy Limbaugh manipulated the comps and the appraisal so she was able to make a few thousand more dollars in commission.  We then confirmed that Lucy lied to prevent the first closing from proceeding as scheduled.

We immediately filed a complaint with the Texas Real Estate Commission.  Sadly, TREC is not required to investigate our claim because the event in question occurred over four years ago.  Everyone must accept the law, but we often see that Justice and The Law are unrelated.

The following documents are in the public record, but the practices of the Texas Real Estate Commission interfere with the ability of the public to access the record.  As a result, when an individual is listing a home with any given real estate agent, s/he has no way to determine if the agent is, in fact, ethical except for the assurances of that agent.  This arrangement enables predatory agents to continually perpetrate fraud on an unsuspecting public.

We intend to remedy that situation by posting these documents in a forum where the public can easily access the records.  

Because we are unable to assert our rights and prove our claim under the Law, Lucy Limbaugh will never be held accountable for her behavior.  She is currently telling everyone in the neighborhood who will listen that although we did list with her for six months in 2009, nothing in our neighborhood in this price range is selling and we have blamed her for broader economic conditions.

We do blame Lucy Limbaugh - but not for the economy.  We blame her for committing fraud. 

*Note*  Very likely, Heritage Texas Properties was unaware of Lucy's pervasively questionable ethics in 1998.  As it happened, the house we bought was her very first listing with that brokerage.  We have wondered if Lucy screwed everyone over for a few thousand bucks or if she also wanted to make points with her new brokerage.   We only hope that Texas Heritage does not routinely condone unethical practices by their agents.
